Reach:

• The following Terms & Conditions, govern the contract between the user and Rockstar Climbing in Nicosia, and come into effect upon entering facilities.
• The Terms and Conditions govern the use and participation in any activity of the facilities of Rockstar Climbing, including but not limited to the use of the bouldering area, the Kilter board, fitness and climbing equipment, the rental or lending of equipment, climbing classes, competitions, events and/or any other activity organised into Rockstar Climbing by anyone.
• Rockstar Climbing Terms & Conditions and the Liability Waiver agreement are part of the Registration and set the conditions for the proper use of all Rockstar Climbing facilities.
• All training sessions, lessons, classes, courses organized by Rockstar Climbing are subject to the Terms & Conditions.
• By participating in any event including competitions organized by anyone including Rockstar Climbing, competitors and spectators must comply with the Terms & Conditions and in addition to any possible restrictions of the event.
• Failure to comply with the Terms & Conditions will result in automatic expulsion from the facilities and permanent cancellation of the user’s membership with Rockstar Climbing, without compensation. Rockstar Climbing reserves the right to limit or deny entrance to the facilities for safety reasons or inappropriate behaviour.

Consent: personal and/or parental for minors:

• The user and/or legal representative and/or parent/ guardian in case of minors understands and accepts that:
• Climbing is a dangerous activity not free from the risk of death or injury that may require medical assistance.
• Is responsible for their own actions and consequences.
• Climbs and/or consent to their child to climb at their own risk.
• The cost of any medical assistance might be required because of any type of accident or injury during the activity will not be covered by Rockstar Climbing.
• They meet the physical and mental conditions necessary to use the facilities of Rockstar Climbing and participate in any activity.
• Rockstar Climbing guarantees the proper operation of its facilities but is fully exempt from any eventuality, setback, difficulty, problem, injury, or accident resulting from training, climbing practice, or related dangers.
• For any damage or harm caused intentionally, Rockstar Climbing reserves the right to claim compensation, which may be effective and binding on closest relatives, family, guardians, administrators, and assigns of the user in the event of their death. By signing this contract, the user unconditionally releases and discharges Rockstar Climbing from any claims, compensation, obligations, and causes or rights of action, known or unknown, resulting from the user’s participation in Rockstar Climbing activities, including claims for ordinary negligence. Furthermore, by signing this contract, the user agrees to indemnify Rockstar Climbing for any third-party claims, obligations, or rights of action arising from their participation in Rockstar Climbing activities.
• In case of an accident Rockstar Climbing may provide first aid and arrange necessary medical assistance if the user is unable to make decisions for themselves. The user agrees to pay all costs incurred for Rockstar Climbing to proceed in this manner. The user agrees to indemnify and hold harmless Rockstar Climbing from any consequences resulting from such assistance.
• The opening hours and access restrictions can change without notice and may be reviewed both in the website and on the official Google profile of the gym.

Access:

• To access the facilities of Rockstar Climbing, it is mandatory to Register via MyFitnessTrainer.
• Each user must sign the informed consent agreement. By signing this document, each user accepts the Terms & Conditions. For minors, variations apply. See the section on rules for minors under 18 years old.
• In case of closure or restricted access, no partial refund will be provided to members and holders of active passes.
• Rockstar Climbing reserves the right to temporarily limit access to certain areas of the facilities for reasons such as classes, competitions, events, cleaning, repairs, wall maintenance, the setup of new climbing routes, or any other special event previously communicated.
• Such access restrictions will be published and do not justify any refund of the entry or pass price.

Fees and Memberships:

• Memberships and/or passes are personal and non-transferable.
• Day passes are only valid for the purchase date.
• Punch cards have an expiration date that is mentioned in the MyFitnessTrainer App. Punch cards cannot be paused and unused visits after their expiration are non-refundable
• Prepaid passes of 30 days, 90 days, 180 days (or any other set duration) will expire on the last day of the subscription and will not automatically renew, so no cancellation is required.
• Prepaid passes can only be paused with a medical certificate justifying the pause. Rockstar Climbing reserves the right to apply this pause based on the verified injury.
• Registration fees must be paid at the time of registration.
• Only first-degree relatives with a valid supporting document can apply for the family rate.
• In case of injury or illness (with a medical certificate), memberships can be suspended during the duration of the injury/illness.
• Member benefits and facility access are suspended during this period.
• Rockstar Climbing reserves the right to review the prices and Terms & Conditions at any time and notify clients at the facilities and on the website. The application of the Terms & Conditions takes effect the day of registration for any prepaid contract or temporary access.
• Any modification of the Rockstar Climbing Terms and Conditions will take effect on the first day of the contractual period following the modification, unless the member decides to cancel under the previously mentioned conditions.

Classes & coaching:

• Participation in the classes and/or personal coaching and/or other courses require pre-registration and prepayment and is subject to availability. Rockstar Climbing members will have priority for signing up and/or additional benefits.
• Lessons for kids are recurring activities, and at the time of registration, the schedule for attendance must be selected.
• Lessons for kids require payment of the annual registration fee at the time of registration.
• Lessons for kids and adults’ classes have a maximum capacity, and if full, there is an option to join the waiting list. If a spot opens, the course will be filled following the waiting list order.
• Lessons for kids start in September and end in June.
• Kids should have their own climbing shoes. The cost of climbing shoes is not included in the lesson’s fees.
• Classes are not held on public holidays. These will include national holidays and local holidays.
• Birthday parties and events for groups are not recurring and must be reserved at reception for a specific day and time, which must be chosen at the time of booking.

Terms & Conditions for the use of the Bouldering Area

Not allowed:

• Access to minors under 18 years old, except for supervised activities by our coaches.
• Don’t step on the mattress barefoot or wearing your regular shoes.
• No eating and drinking on the mats, leaving equipment in the climbing area (shoes, clothes, etc.)
• No climbing without a shirt.
• Don’t stay under the climbing area. Don’t pass over other climbers while traversing and don’t let others pass over you when they are traversing.
• No climbing above the top of the boulders, holding the edge of the panels or in areas not designated for climbing.
• No powdered chalk.
• No screaming. No swearing. No arguments. No political discussions.
• No earphones. No speakers.
• No smoking indoors/outdoors. No bubble gum.
• No climbing with rings, jewellery, bracelets.
• No coaching others. No unwanted beta.

Recommended:

• Enter the climbing area wearing your climbing shoes. Walking on the mat with socks allowed.
• Check that the climbing area is clear, do not jump from the highest points and notify verbally.
• Spot others if they ask and brush the holds after you finish.
• Liquid chalk only. Please apply a small amount to your fingertips and allow to dry completely before you touch the holds.
• Our climbing walls feature routes of various difficulty levels. If you’re a beginner, we recommend starting with easier routes to get comfortable. You can find route grades clearly marked on the wall.
• Spot climbers only if they ask and you agree. A good spotter helps prevent injuries by guiding falls safely to the mat. Always pay attention to the climber’s position.
• Make sure to warm up before you start. This can help prevent injuries.
• Stay hydrated. Bring a water bottle or buy one on-site.
• Be considerate of others on the wall. Share space, wait your turn, and communicate clearly with fellow climbers. Respect their time on routes.

Terms and Conditions for Minors

• Minors under the age of eighteen are permitted to access Rockstar Climbing facilities only when accompanied by a parent or legal guardian, who must sign the waiver of responsibility agreement.
• The minimum age requirement for using the facilities is six years old. Children below this age are not permitted to access the facilities.
• Children aged 6 to 18 can use the facilities only during lessons for kids, with parent or guardian registration and a signed waiver.
• The legal representative consents to the minor using Rockstar Climbing facilities and participating in activities, confirming they are the parent/guardian. They waive all rights to claim or sue Rockstar Climbing for any incidents arising from these activities.
• Rockstar Climbing reserves the right to deny entry to minors for reasons of safety or inappropriate behaviour.

Terms and Conditions for Birthday parties & events

• Orders for the menu must be placed at least four days prior to the party
• Changes on the menu cannot be made at the day of the event
• Water and/or additional juice are not included in the price
• The client is allowed to bring the birthday cake. Jelly is not allowed
• The client is responsible for the preparation & presentation of their birthday cake
• The client is responsible to bring plates, napkins & cutlery
• Party duration is 3 hours
• No piniatas, no party poppers, no confetti, no party horns
• No pop corn and/or other sweets and treats on the tables

Cancellation policy for birthday parties and events:

• All deposits are non-refundable and cannot be transferred to others.
  Cancellations more than 30 days out: If you cancel with more than 30 days notice from the scheduled date, you can use the deposit amount for another date.
  Cancellations within 30 days: If the cancellation is done within a period shorter than 30 days of the scheduled date, the deposit is lost.
• For events, competitions, camps, etc., special cancellation conditions may apply. If none are specified, the above-mentioned conditions will apply.

Rental of Equipment:

• Rental of equipment must be done at the reception and must be returned before leaving the premises.
• Damages due to misuse of equipment will be charged to the customer, who must pay the replacement cost at the public sale price.
• Any equipment rented at Rockstar Climbing is only for use within those facilities and cannot be taken outside the location where it was rented.

Personal Belongings:

• Rockstar Climbing recommends not to bring or leave valuable items in the facilities or in the lockers and cannot be held responsible for any items that are lost at any of the facilities, including items left in the lockers.
• Lockers are for daily use. If a locker contains personal belongings when the facility closes, it will be emptied, and its contents will be placed in lost and found until claimed.
• Lockers at Rockstar Climbing can’t be locked.
• Items left in lockers, changing rooms, or other parts of the facility will be kept in lost and found for up to 2 weeks. If not claimed within this period, the facility management will donate or dispose of the items.

Data Protection:

• Per GDPR (EU) 2016/679, the user’s data will be stored and processed by our POS system, managed by Rockstar Climbing.
• The user allows Rockstar Climbing to use their data for facility management, activities, and marketing campaigns.
• Rockstar Climbing may photograph and video clients in the facilities, without compensation.
• Photos and videos may only be taken for personal use, and not focused on any other clients who do not wish to appear in them.
• Commercial videos and photographs not authorized by Rockstar Climbing are prohibited. If you wish to take such media, please e-mail us to receive written authorization.
• Recording videos and taking photographs in the changing rooms is strictly prohibited.

Notification of Defects:

• Users are requested to promptly report any deterioration or issues to Rockstar Climbing staff. This ensures a safer environment and reduces risks. Not reporting an issue will not void a warranty claim, but negligence will be penalized.

Additional Provisions:

• Rockstar Climbing can change the Terms & Conditions and Liability Waiver Agreement as well as current fees, and any other legal document at any time. Such changes will take effect immediately after being communicated with the members.
• The Terms and Conditions are governed by Cyprus law. If any part of this contract is invalid or unenforceable, it does not affect the validity of the rest of the provisions, unless it affects the essential rights and obligations of the parties (the user and Rockstar Climbing).
